    Payment of additional leave for certain categories of persons who suffered from the Chernobyl accident

     

    Payment for additional leave is granted to the persons indicated in article 6 of the Law no. 909-XII of January 30, 1992 and to the persons indicated in point 1 of the Government Decision no. 575 of September 2, 1992, namely:

    a) persons who fell ill and suffered from actinic disease caused by the Chernobyl nuclear power plant accident, as well as persons whose disability is causally related to the Chernobyl accident, including: 

    persons (temporarily directed or sent on mission) who participated in the liquidation of the aftermath of the damage in the disposal area or in other works at the Chernobyl nuclear power plant;

    military staff, employees of internal affairs bodies, military subjects recruited in special camps, those who have completed their service in the Armed Forces, State Security Committee troops and bodies, internal affairs and railway troops, other formations and have been involved in the liquidation of the aftermath of the accident in the disposal area or in other work at the Chernobyl nuclear power plant;

    persons who came in 1986 from the disposal area and acquired citizenship of the Republic of Moldova;

    a1) persons (temporarily directed or sent on mission) who took part in the 1986-1987 work of liquidation of the aftermath of the Chernobyl nuclear power plant accident, in the disposal area, as well as military staff, workers of internal affairs bodies, military subjects recruited in special cantonments, those who have served during this period in the Armed Forces, in the troops and bodies of the State Security Committee, in the internal affairs and railway troops, in other military formations and who have carried out liquidation work in the aftermath of the damage in question in the disposal area;

    a2) persons (temporarily directed or sent on mission) who participated in the 1988-1990s in the liquidation of the aftermath of the Chernobyl nuclear power plant accident, in the disposal area, as well as military staff, recruited in special camps, those who served during this period in the Armed Forces, in the troops and bodies of the Committee for State Security, in the internal and railway troops, in other military formations, and who carried out work in the disposal area of the aftermath of the accident in question;

    b) employees of high-risk subdivisions (military staff and civilian employees of the Armed Forces of the former USSR, troops and organs of the Ministry of National Security, internal troops, railway troops and other military formations, senior and junior staff of internal affairs bodies) who have fallen ill with actinic disease or have been classified as disabled and have participated directly in:

    - testing of atmospheric nuclear weapons and radioactive warfare substances in applications in which such weapons have been used, until the date of actual cessation of such testing and applications;

    - underground nuclear weapon testing under conditions of exceeded radiation levels and other destructive factors of the nuclear weapon;

    - assembly of the nuclear weapon (the manpower of certain subdivisions);

    - damage clearance of nuclear installations on surface ships and submarines and other military targets;

     

    - underground testing of nuclear weapons, carrying out and ensuring the collection and burial of radioactive substances.

     

    Payment for additional leave is determined by the employer on the basis of the request submitted by the beneficiary, provided that the necessary documents are presented.

    The following documents must be enclosed with the application:

    - identity card confirming the citizenship of the Republic of Moldova;

    - identity card of participation in the liquidation of the consequences of the Chernobyl accident;

    - certificate of disability and work capacity issued by the National Council for the Determination of Disability and Work Capacity or its structures confirming that the disability is caused by the Chernobyl accident;

    - identity card of collaborator of the subdivisions of special risk.

    The application, together with the documents mentioned above, shall be submitted to the place of work by 31 December of the year in question.

    The applicant shall submit to the Territorial Office of Social Insurance of the place of residence the application for payment of additional leave, the certificate of the amount fixed by the employer for payment and a copy of the order granting additional leave.

    The payment of calendar compensation and material aid to citizens who have suffered from the Chernobyl disaster and their families shall be made by the payment service provider designated by the beneficiary upon request. The designated payment service provider concludes a contract with the National Office of Social Insurance.

    The compensation shall be paid personally to the holder, their guardian, trustee, proxy.

    The compensation shall be paid to the proxy only upon presentation of the power of attorney, the validity of which may not exceed 6 consecutive months. If the beneficiary is domiciled abroad, the compensation shall be paid up to the month in which he is removed from the register. If the beneficiary changes his place of residence, payment of the compensation is suspended at the previous place of residence and is resumed on the basis of an application submitted by the beneficiary by decision of the territorial office of social insurance of the new place of residence. If the compensation is established and the beneficiary has not been able to receive it due to death, the full amount of the compensation may be paid, including the month of death, to the surviving spouse, parents, children, and in their absence - to the person who proves that he or she has borne the expenses arising from the death. Payment of compensation during the period of deprivation of liberty is not suspended. Payment of compensation to persons sentenced or detained in penitentiary institutions shall be suspended at the place of residence and transferred to the current account of the place of residence for the means temporarily in the possession of the penal institution where the person is detained.

     

    Persons living in homes for the elderly and disabled are fully compensated.

     

    The amount required for payment of additional leave shall be calculated by the employer.
