    Death allowance in case of death of the insured person as a result of an accident at work or occupational disease

    Following the work accident or occupational disease resulting in the death of the insured person, in addition to the survivor pension, the survivors shall receive a death allowance, pursuant to art. 18 of the Law on insurance against work accidents and occupational diseases no. 756 - XIV of 24.12.1999.

    The following shall be entitled to death benefit for the insured person as a result of the work accident or occupational disease:

    a) children of the insured who, at the time of his/her death:

    - are up to the age of 18 years or have reached that age, but not over the age of 23 years, if they are continuing their education at secondary, secondary vocational or higher education institutions, daytime courses;

    - are classified as disabled, regardless of age;

    b) the insured person's spouse, who at the time of his/her death:

    - is classified as disabled;

    - has reached retirement age;

    c) the spouse or one of the parents of the deceased insured person, or another person who, at the time of the insured person's death, is not working and is caring for the insured person's children under the age of 3.

     

    The death allowance is granted once in a fixed amount.

     

    The death allowance is determined by the Territorial Office of Social Insurance according to the place of residence, presenting the following documents:

    - report of the investigation of the accident at work or of the occupational disease (original or authenticated with a wet stamp of the State Labour Inspectorate);

    - death certificate of the insured person (original and copy);

    - identity card (original and copy);

    - other documents proving the applicant's entitlement under the legislation.

    The granting of the death allowance or the rejection of the application for the death allowance is made by decision of the Territorial Office of Social Insurance within 45 days from the date of submission of the application.

    The decision to grant or reject the application for death allowance shall be notified in writing to the applicant within 5 days of the date of its issue.

     

     

     

     

    The death allowance is paid once, in a fixed amount, corresponding to the number and category of dependants as follows:

    a) for children up to the age of 18 and over, but not exceeding the age of 23, if they are continuing their education at secondary, secondary vocational and higher education institutions, daytime courses, or for disabled children, regardless of age:

    - the equivalent of 5 salaries, calculated as the average of the insured monthly salary of the deceased insured person for the last 6 months preceding the month in which the accident at work or occupational disease occurred, but not less than 5 average monthly salaries in the economy for the year preceding the year in which the insured event occurred, for a child;

    - the equivalent of 8 salaries, calculated as the average of the insured monthly salary of the deceased insured person for the last 6 months preceding the month in which the accident at work occurred or the occupational disease was diagnosed, but not less than 8 average monthly salaries in the economy for the year preceding the year in which the insured event occurred, for two children;

    - the equivalent of 12 salaries, calculated as the average of the insured monthly salary of the deceased insured person for the last 6 months preceding the month in which the accident at work or occupational disease occurred, but not less than 12 average monthly salaries in the economy for the year preceding the year in which the insured event occurred, for three or more children;

    b) for the insured person's spouse who, at the time of death, is disabled or has reached retirement age - the equivalent of 3 salaries, calculated as the average of the insured person's insured monthly salary for the last 6 months preceding the month in which the accident at work or occupational disease occurred, but not less than 3 average monthly salaries per month in the economy for the year preceding the year in which the insured event occurred;

    c) for the spouse or one of the parents of the deceased insured person, or another person who, at the time of the insured person's death, is not working and is caring for the insured person's children under the age of 3 - the equivalent of 3 salaries, calculated as an average of the insured person's insured monthly salary for the last 6 months preceding the month in which the accident at work occurred or the occupational disease was diagnosed, but not less than 3 average monthly salaries in the economy for the year preceding the year in which the insured event occurred.

    A person who is in more than one of the situations provided for will receive the allowance set for only one of these situations.

    The total amount of the allowances granted may not exceed the equivalent of 24 average monthly salaries in the economy.

    If the total amount of death allowance is higher than the limit laid down, the allowance to each person entitled shall be reduced proportionately.
