• Disability allowance

    Following a work accident or occupational disease, the insured persons receive, in addition to the disability pension, a disability allowance under art. 16 of the Law on insurance against accidents at work and occupational diseases no. 756 - XIV of 24.12.1999.

    Disability allowance is granted to beneficiaries who, as a result of the work accident or occupational disease, have lost all or at least 35% of their working capacity and are classified as disabled.

     

    The amount of the disability allowance varies according to the degree of disability of the insured person.

     

     

    In order to determine the disability allowance, beneficiaries of the public social insurance system are obliged to submit the following documents to the Territorial Office of Social Insurance according to their place of residence:

    - report of the investigation of the accident at work (original or authenticated with a wet stamp of the State Labour Inspectorate) or the advisory report issued by the Republican Centre for Occupational Diseases

    -  certificate of the NCDDWC (original)

    - identity card (copy),

    - other supporting documents as necessary.

    If the beneficiary works in more than one establishment, the insured income from all the establishments is taken into account.

    The disability allowance is granted upon request of the entitled person within 60 days from the date of determining the degree of disability, with the attachment of all confirmatory documents and is submitted to the territorial structures of the National Office of Social Insurance. If the last supporting document is submitted after the expiry of 60 days, the allowance is granted from the date of submission of the last document.

    Disability allowance is granted or the application for disability allowance is rejected by decision of the territorial office of social insurance within 45 days of the date of submission of the application.

    The decision rejecting the application for disability allowance shall be notified in writing to the applicant within 5 days of the date of issue and shall include the factual and legal grounds on which the application is granted or rejected. 

     

     

    The amount of the disability allowance for an insured person classified as severely or marked disabled is determined by the difference between 2/3 of the insured person's average insured monthly income for the last 6 months preceding the month in which the accident at work occurred or the occupational disease was diagnosed and the amount of the insured persons disability pension established by the public social insurance system.

    The amount of the disability allowance for an insured person in the average degree of disability is determined as a percentage of the difference between 2/3 of the insured person's average insured monthly income for the last 6 months preceding the month in which the accident at work occurred or the occupational disease was diagnosed and the amount of the insured person's disability pension corresponding to the degree of reduced capacity for work.
