    Indemnity for temporary work incapacity

    The indemnity for temporary work incapacity is established in accordance with the Law on temporary work incapacity indemnities and other social insurance benefits, no. 289/2004 and the Regulation on the conditions for establishing, calculation and payment of temporary work incapacity indemnities, approved by Government Decision no. 108/2005.

    The indemnities for temporary work incapacity caused by ordinary illnesses or non-work-related accidents, granted from the employer's means, shall be determined, calculated and paid by the employer for the first five calendar days of temporary work incapacity, but not more than 15 cumulative days for each employee during a calendar year, in the case of several periods of temporary work incapacity.

    The indemnities, granted from the employer's means, are established by the employer(s) on the basis of the original or copy of the paper medical certificate. At the employee's request, the employer to whom the original certificate is presented shall submit a copy/copies marked "it is a true copy" for presentation to other employers where the person is employed.

    Insured persons domiciled or residing in the Republic of Moldova and unemployed persons entitled to indemnity for temporary work incapacity are entitled to unemployment benefit". 

    The National Office of Social Insurance determines, calculates and pays indemnities for temporary work incapacity granted from the state social insurance budget on the basis of the information contained in the medical certificate, transmitted via secure inter-system connections and authenticated by the electronic signature of the responsible person of the health care providers.

     

    Individuals are entitled to temporary work disability under the following conditions:

    a) A total contribution period of at least 3 years.

    b) Insured individuals confirming a total contribution period of up to 3 years are entitled to allowances if they confirm a contribution period of at least 9 months within the last 24 months preceding the date of the insured risk occurrence.

    Unemployed individuals are entitled to allowances if they confirm the necessary contribution period, provided that the payment of unemployment benefits is suspended for this period.

    Allowances for temporary work disability caused by tuberculosis, AIDS, or oncological diseases are established regardless of the duration of the contribution period.

    For cases when the sick leave overlaps with periods of work activity, the salary is paid, not the allowance.

    Starting from January 1, 2024, the allowance for temporary work disability caused by common illnesses or non-work-related accidents, paid by the employer, is established regardless of the contribution period.

     

     

    The data from medical certificates transmitted to the National Office of Social Insurance for the establishment of allowances are examined within up to 15 calendar days from the date of receipt. If the necessary information for establishing the allowance is incorrect/incomplete, or if there is a lack of data, the examination period extends to 30 calendar days from the date of receiving the data from the medical certificate.

     

    The amount of the allowance for temporary work disability paid by the employer is established at 75% of the employee's average salary, determined as prescribed by the Government.

    The amount of the allowance for temporary work disability paid from the state social insurance budget is differentiated based on the duration of the total contribution period, as follows:

    a) 60% of the calculation base for a contribution period of up to 5 years.

    b) 70% of the calculation base for a contribution period between 5 and 8 years.

    c) 90% of the calculation base for a contribution period of over 8 years.

    d) The amount of the allowance for temporary work disability caused by tuberculosis, AIDS, or oncological disease is 100%.

    The calculation base for the allowance for temporary work disability is the average monthly insured income realized in the last 12 calendar months preceding the month of the insured risk occurrence (illness), income from which, at the time of establishing the allowance, contributions have been calculated and paid.

    The insured income for the months included in the calculation to determine the base of the allowance for temporary work disability cannot exceed the sum of 5 forecasted average monthly salaries in the economy for that year multiplied by 12 or by the number of months in which the person had insured income. If an incomplete calendar year is included in the calculation, the insured income is capped based on the number of months in which insured income was realized for that specific year. The forecasted average monthly salary in the economy is approved by the Government.
